Staff Analysis of the Legislation

            This bill would amend Chapter 2A of Title 20 of the O.C.G.A. to require that enrollment and attendance records of students who attend schools that use scholarships or grants from a student scholarship organization be subject to the open records law. It would also require annual reports to the SBOE regarding the number of students enrolled in institutions receiving scholarships or grants from the organizations, the amount of funding received with individual breakdowns (without individual identifying information), data regarding the public schools formerly attended by scholarship students with demographic data for each student. It would also remove the annual adjustment to the maximum amount of tax credit allowed, therefore limiting the maximum to the current $50 million per tax year.
