Staff Analysis of the Legislation

         This bill would amend Chapter 10 of title 13 of the O.C.G.A. and Chapter 91 of Title 36 of the O.C.G.A. to provide that, if a sealed competitive bid is requested and cost is not a selection or evaluation factor, no bid bond would be required, unless it is specified in the RFP and specifies the amount required.

            It would provide for liquidated damage provisions for late construction completion and incentive provisions for early completion when the project schedule is valuable. Those damages and incentives would have to be established in advance as part of the contract.
