Staff Analysis of the Legislation

            This bill would amend Chapter 2 of Title 20 of the O.C.G.A.to provide a bill of rights for teachers. That bill of rights would include the right to:

1.      Offer Constructive criticism in a professional manner with LBOE members and administrators respecting the teacher’s right to independent thought and expression of constructive criticism;

2.      Associate or not with an educational professional organization or association without suffering reprisal;

3.      Be assured that no coercion, threats, or intimidation to change a student’s grade or test score would occur if the teacher believes the score or grade were earned;

4.      Remove a disruptive student with no return for at least that day, and no questioning the teacher about what happened in front of another student;

5.      File a complaint about an evaluation the teacher considers unfair, false or retaliation;

6.      Participate in an annual evaluation of each principal and assistant principal in the school in a confidential and anonymous manner with the evaluation forwarded to the superintendent, who would send copies to all LBOE members;

7.      Be assured of no discrimination on the basis of race, gender, age, religion, nationality, disability, or exercise of the freedom of association;

8.      No treatment in a capricious or arbitrary manner;

9.      Full credit or experience upon transfer to another system regarding eligibility for any local supplement; and

10. Selection of Teacher of the Year in each school conducted solely by anonymous votes of the teachers of the school.
