Staff Analysis of the Legislation

            This bill would amend Article 3 of Chapter 2 of Title 20 of the O.C.G.A. to make any LBOE member who votes against submission to the federal Voting Rights Act, votes to withdraw submission, or takes no action toward complying with the submission within the designated time from would be guilty of a misdemeanor. LBOE’s would be prohibited from expending public funds for attorney’s fees or expenses of litigation for a member accused of violating this proposed law. Should a LBOE fail to submit to the federal Voting Rights Act, the Attorney General would be charged with causing compliance or taking action to enforce compliance through  seeking civil or criminal penalties.
