Staff Analysis of the Legislation

            This bill would amend Article 10 of Chapter 2 of Title 20, Title 36, and Part 1 of Article 3 of Chapter 5 of Title 50 of the O.C.G.A. to modify purchasing procedures. The bill would modify wording to require giving preference to Georgia providers, if the desired services or goods are available. It would eliminate the current paragraph on bidding procedures and would replace it with a requirement to state in the bid request a notice that the district/school would consider information relating to the impact on employment in Georgia. Any bid that would be considered would have to contain an employment impact statement to include:

1.      The number of jobs to be created or retained if the contract went to another contractor;

2.      The number of jobs to be created or retained if the contract went to another contractor by the subcontractors expected to be used;

3.      A guarantee from the contractor that the jobs created or retained would not be moved outside the state during the duration of the contract.

The bill goes further to specify particular purchases by DOAS that would have to give Georgia providers preference.
