Staff Analysis of the Legislation

This bill would amend Article 10 of Chapter 2 of Title 20 and Article 4 of Chapter 91 of Title 36 of the O.C.G.A. to impose requirements on LBOE contracts and purchases:

1. All contracts for professional services exceeding $50,000.00 over 12 months would have to be awarded by competitive sealed bids, unless the LBOE determines that the services are unique and can be obtained by a single source;

2. SBOE would have to establish rules and regulations to carry out the law.

3. A construction manager who works with a project pre-design phase or a general contractor who does the same would have to be procured by competitive bids, and the guaranteed maximum price would not be able to change once the contract is executed.
