HB 186 (Reps. Setzler-R, Gravley-R, and Donahoo-R) This bill attempts to bring some clarification and consistency to the provisions of HB 60 and HB 826, which passed during the 2014 session. This bill amends current code to: - Define school as a public or private educational program or institution instructing children at any level, pre-kindergarten through twelfth grade.
- Define school bus as
- A motor vehicle operated for the transportation of children to and from school or school activities. The defininition specificially excludes a privately owned motor vehicle with a passanger capacity less than 15 unless it is being operated by an employee or independent contractor of a school.
- A motor vehicle operated by a local transit system which meets the equpment and identification requirements as a school bus, provided, however, that such motor vehicle shall be a bus only while transporting children or children and employees or independent contractors of a school to or from school or school activities.
- Define School Safety Zone as "in or on any real property or building owned by or leased to a school or postsecondary institution."
- Define weapon as a handgun, rifle, shotgun, or pistol, revolver or any other weapon designed or that can be converted to expel a projectile by the action of an explosive or electrical charge; dirk, bowie knife, switchblade knife, ballistic knife, any knife having a blade of 2 or more inches, straight edge raxor, razor blade, spring stick, knuckles, bat bludgeon, club flailing instrument, disc with points or blades, stun gun or taser.
- Prohibit the possession of weapons (as defined above) in schools, school safety zones, at school functions, and on school buses.
