HB 316 clarifies what entities regulate towing companies. Currently, the Public Service Commission regulates towing firms, but municipalities also may require licenses for towing firms that operate within their municipality. HB 316 clarifies that the firms the firms operating within the municipalities are subject to PSC regulations and requires them to get a nonconsensual towing permit from the commission. Also, the bill allows municipalities to set lower price rates (but not higher rates) and require higher public liability insurance.

This bill received a Do Pass recommendation from the Judiciary Non-Civil Committee and comes to the House Floor under the Open Rule.

WHAT PROBLEM/OPPORTUNITY DOES THIS LEGISLATION ADDRESS?

To provide the Public Service Commission and the governing authority of municipalities concurrent jurisdiction on matters regarding the regulating and controlling the towing and removal of certain vehicles

 

WHAT IS THE DRIVING FORCE BEHIND THIS LEGISLATION?

To give the Public Service Commission the authority to set just and reasonable rates, fares, and charges for services related to the removal storage and required notification to owners of towed vehicles.
