HB 317 clarifies definitions related to regulations for motor common carriers. While taxicabs, etc. may be regulated by municipalities where they operate, moving vehicles and certain passenger vans are excluded and remain under Public Service Commission regulation. Also, tow trucks engaged in nonconsensual towing remain subject to the PSC�s jurisdiction.

This bill received a Do Pass recommendation from the State Planning & Community Affairs Committee and comes to the House Floor under the Open Rule.

WHAT PROBLEM/OPPORTUNITY DOES THIS LEGISLATION ADDRESS?

House Bill 317 closes a loop hole in the current law by amending OCGA-46-1-1(c) that allows movers operating only within cities to operate outside the Commission�s jurisdiction.

 

THIS LEGISLATION:

  • Treats all movers the same by having adequate liability and property insurance.  The consumer would have comfort of not worrying about losing their household goods without any recourse.
