HB 383 makes changes to the Georgia Condominium Act to allow the creation of master condominium and sub-condominium associations. The bill also provides that a condominium owner is not required to have a certificate of occupation in order to own the condominium.

WHAT PROBLEM/OPPORTUNITY DOES THIS LEGISLATION ADDRESS?
This bill addresses current issues with the increased development of residential condominiums and mixed-use developments in Georgia by creating a legal definition for sub condominiums which will have separate legal rights and obligations for the sub condominiums. The bill also allows a unit to be sold prior to the issuance of a Certificate of Occupancy, so as to permit a purchaser to design the interior prior to issuance.
