HB 386 allows the superior court clerk to charge a $2.00 fee for cross-indexing, as well as changes provisions related to the filing of instruments which include requests for cancellation, satisfaction or release of instruments pertaining to real estate.

This bill received a Do Pass recommendation from the Judiciary Committee and comes to the House Floor under the Open Rule. The Senate added a new sections which change the sunset dates on various court fees from the year 2012 to 2014.

WHAT PROBLEM/OPPORTUNITY DOES THIS LEGISLATION ADDRESS?

HB386 modernizes the recording and cancellation of deeds and liens.  This bill provides for an additional fee when cross-indexing is requested.

 

WHAT IS THE DRIVING FORCE BEHIND THIS LEGISLATION?

The real estate bar�s desire to modernize the recording and cancellation of deeds and liens.
