Staff Analysis of the Legislation

HB 214 requires scheduled overtime, but not unscheduled overtime, of a professional firefighter or EMS personnel to be included in the computation of the average weekly wage as set forth in KRS 342.140 for workers' compensation benefits only. "Scheduled overtime" is defined as work in excess of 40 hours per week that regularly recurs as a direct result of an established work schedule adopted by or required by the employer of a professional firefighter or EMS personnel. 

HB 214 would directly affect cities that employee firefighters on a 24/48 work schedule. KLC opposes the bill because it would increase the workers compensation indemnity payments to firefighters by approximately 12 percent, which would cause increases in workers compensation insurance premiums paid by many cities.  The amount of premium increases would vary among the cities, hitting those cities with more firefighters on the payroll harder.

     AN ACT relating to workers' compensation benefits for firefighters.
     Create a new section of KRS Chapter 95A to require that scheduled overtime for professional firefighters and EMS personnel be included in the computation of the average weekly wages for workers' compensation
benefits .

     HCA (1, S. Riggs) - Retain the original provisions, except change the definition of EMS personnel to clarify the individuals impacted by the bill and to clarify that scheduled overtime hours are calculated at the overtime rate of pay and unscheduled overtime hours are calculated at the regular rate of pay.
