HB 1138 (Correctional Services – Inmate Welfare Fund – Telephone Financial Assistance) and SB 778 are formally listed as cross-files but are slightly different bills. MACo opposed SB 778 as its provisions applied to both the State and local correctional facilities. However, HB 1138’s provisions only apply to the State, so it would not make sense for MACo to come in and oppose. So I think we will need a bill report to reflect that we are not opposing HB 1138 in its current form. We do need to continue with our oppose position on SB 778.
I think because we did not bring this bill by number to the Leg Cmte (right, Les?) we don’t need to do anything but re-code it in our database. We believed it to be a cross-file, it was listed that way, but the bill is actually different than the one we did raise for a position.
Based on that logic, and unless Les says otherwise, I say we can just re-code it as NI, and leave it at that.
