Staff Analysis of the Legislation

The fourth substitute of this bill enacts a victim targeting penalty enhancement under Utah’s Criminal Code. The bill provides for an enhanced penalty when a defendant is convicted of a crime the defendant committed against a victim because of a victim’s personal attribute. Protected personal attributes include age, ancestry, disability, ethnicity, familial status, gender identity, homelessness, marital status, matriculation, national origin, political expression, race, religion, sex, sexual orientation, service in the U.S. Armed Forces, status as an emergency responder, or status as a law enforcement officer, correctional officer, special function officer, or other peace officer.
