Staff Analysis of the Legislation

This bill prohibits individuals from holding or using a cell phone while driving, except in emergency situations. Individuals may not read a message or view or record a video while operating a vehicle. However, activating or deactivating a feature or function of a cell phone with a single swipe or finger tap is allowed while driving if the device is mounted in the vehicle. 

Violation of the bill is a class C misdemeanor. If there is serious bodily injury to another or repeat offenses it is a class B misdemeanor.
