Staff Analysis of the Legislation

This bill is a result of stakeholder collaboration over the interim to address water issues and is tied to proposed changes in SB 17, Extraterritorial Jurisdiction Amendments, and HB 31, Water Supply and Surplus Water Amendments. The Natural Resources, Agriculture, and Environment Interim Committee and the Legislative Water Development Commission recommend this resolution that proposes to repeal and replace Article XI, Section 6 of the Utah Constitution. Article XI, Section 6 currently prohibits municipalities from directly or indirectly leasing or selling water outside of its jurisdiction. The constitutional amendment would empower cities with the authority to enact an ordinance to designate geographic limits of a water service area beyond its jurisdictional boundaries and define the terms of service.
