Staff Analysis of the Legislation

Representative Hall is concerned about the privacy of those who create documents and store them online (Google Docs, Dropbox, iCloud, etc.). 
 
Last year, Representative Hall proposed to amend the Utah Constitution to protect electronic information and data from unreasonable searches, but Representative Hall received pushback to make this a statutory rather than a constitutional amendment. This bill amends the Utah Code to protect electronic information or data. 

The Judiciary Interim Committee recommends this bill. The bill requires that law enforcement obtain a search warrant to access certain electronic information and data; addresses notification that electronic information or data was obtained; provides for transmission of electronic information or data to a remote computing service, including restrictions on government entities; and provides that the individual who transmits electronic information or data is the presumed owner of the electronic information or data.
