The original bill invoked last session's failed HB 136, which (as amended) required a political subdivision to report to the Legislature if it wanted to advocate for lands to receive a federal designation. Rep. Albrecht introduced a substitute that made this bill substantially more problematic for local government. The bill now amends Utah Code 63J-8-106 by expanding the Legislature's discretion to review, approve, or disapprove a political subdivision's support for a congressional land use designation. To request approval, a political subdivision must draft a detailed report and a concurrent resolution to be submitted to and considered by a legislative committee. If the resolution is adopted by the committee and signed by the Governor, a political subdivision may "officially" support a congressional land use designation. We oppose this bill not only as state government overreach, but for potentially restricting the free speech rights of government entities and their employees. |
