Staff Analysis of the Legislation

This bill limits the use of eminent domain. The bill specifically disallows the use of eminent domain for the following purposes:

  • Establishing trails for walking, hiking, bicycling, equastrian or recreational uses.
  • Establishing a public park on real property that is a century farm and located in a county of the first class. A century farm is defined as a farm that has held by the same family in continuous ownership for over 100 years
