This bill requires a peace officer to issue a citation to an individual charged with misdemeanors or infractions. If a peace officer determines it necessary to arrest an individual for class B or C misdemeanor offenses, the peace officer shall document the reasons supporting the determination.

For certain criminal offenses, the bill creates a presumption of release while awaiting trial. The bill provides that individuals eligible for pretrial release are released under least restrictive conditions and specifies the conditions under which a defendant may be denied pretrial release.
