Staff Analysis of the Legislation

This bill limits a county of the third, fourth, fifth, or sixth class, or a political subdivision within those counties from enacting, establishing, or enforcing a regulation or policy that does the following: 
  • Establishing a setback greater than two miles from a city or town for an agricultural operating on a property that is zoned as agriculture, range and forest, or mixed-use allowing agriculture.
  • Adopting or enforcing standards more stringent than state or federal regulations imposed on agricultural operations.
An agricultural operation within the counties or subdivisions mentioned above is considered in compliance with environmental ordinances and regulations if the property is on land zoned as agricultural; complies with state and federal statutes and rules; and follows best management practices. 

A county or subdivision mentioned above may not take action related to the following:
  • Action against an agricultural operation that is not reasonably related to the development of an agricultural operation.
  • Imposing conditions based upon animal species or livestock housing.
  • Requiring an agricultural operation to rezone property that is to be developed if it is designated as agriculture, range and forest, or mixed-use allowing agriculture.
