Staff Analysis of the Legislation

This bill declares that the Legislature occupies the whole field of state regulation of firearms and ammunition. The bill reserves for the state the authority to regulate firearms and ammunition. The bill states that unless authorized by the Legislature by statute, a local authority may not enact or enforce any ordinance, regulation, rule, or policy that in any way inhibits or restricts the possession or use of firearms, ammunition, or firearm accessory on either public or private property. The bill explicitly limits the Board of Regents and institutes of higher education from enacting firearm restrictions. 
 
The bill allows for civil action should a local authority or state agency attempt to enforce an ordinance, regulation, measure, directive, or rule regulating firearms, ammunition, and firearm accessories. The bill allows for a permanent injunction, a fine of $500 per day, and penalties against the authority or agency attempting to enforce the measure. The bill states that a state agency or authority in violation is not immune from suit or liability for the violation.
