Staff Analysis of the Legislation


This bill has three primary components: 1) jail demographics reporting 2)prosecutorial data collection 3) Court demographics reporting. 

1. Jail Demographics Reporting: The bill requires each county jail to collect and provide the following information on each person booked into the facility: full name, offender tracking number, gender, date of birth, race, ethnicity zip code. 
The information shall be submitted every six months on the last day of June and December of each year for the previous six-month period. 

2. Prosecutorial Data Collection: Beginning July 1, 2021, all prosecutorial agencies shall submit the following information with regards to each criminal case referred by a law enforcement agency: full name, tracking number, date of birth, zip, referring agency, actions of the prosecutorial agency, manner of identifying cases, charges brought, initial appearance date, date of initial discovery of disclosure, pst filing diversion, date of disposition of the case. 

Information to be submitted quarterly and record maintained for ten years. All prosecutorial agencies are to publish office policies beginning July 1, 2021.

A prosecutorial agency not in compliance may not receive grants or other funding intended to assist with compliance. 

The bill requires policies to be published online and sorted by topic, such as: discovery practices, plea bargains, prosecution of juveniles, criminal and forfeiture practices, etc. 

3. Court Demographics reporting: The bill requires the Administrative Office of the Courts to compile and provide the following information for each criminal case filed with the courts: case number, full name, tracking number, date of birth, charges, bail amount, disposition of charges. Information is to be submitted semi-annually.
