Staff Analysis of the Legislation

SUMMARY:  Exempts board members in office on June 30, 2010 from the nepotism provisions related to eligibility to qualify as a candidate for the local board of education, if reelected or reappointed on or after July 1, 2010.

POINTS TO CONSIDER:  HB 251, passed into law in 2009, disqualifies candidates for local boards of education if the candidate has an immediate family member employed in the system as a central office or building level administrator.  This legislation exempts local board of education members from that provision, if the board member is reelected or reappointed on or after July 1, 2010, if the member was in office on June 30, 2010.  

EFFECTIVE DATE:  Upon approval by the Governor or by becoming law without such approval.  If passed, the legislation must be approved by the US Department of Justice.
