The final version of the bill includes a Senate amendment that prohibits the State Board from waiving the early intervention program (EIP) required in 20-2-153.  Charter schools would also be unable to waive it. 

This bill does several things:

  1. Local charter schools would get the same funding boost as charter systems regardless of whether or not they are in a charter system.  The boost is 3.785% of the base amount per FTE.  The charters would get the funding directly from the State Board. [NOTE: There are 77 local charter schools including the 21 college and career academies, most of which are not in charter systems]
  2. It amends some definitions regarding health insurance plans and charter schools.
  3. It deletes current language that says "the Department of Education (DOE) shall implement procedures that ensure each local charter school receives from its local school system" to now say "the local school system shall distribute to the local charter school" its proportionate share of federal funds.
  4. A local charter and a local board of education may mutually collaborate and agree on specific ways for some or all of the proportionate federal funds to be provided by the district through in-kind services.  The terms of the agreement would be in the charter.
  5. The terms of a local charter school's use of a facility owned by a local board of education shall be subject to negotiation between them. 

 

EFFECTIVE DATE:

July 1, 2021 except the additional funding for local charters which becomes effective July 1, 2022.
