HB 189 Water Safety Act: Monitor, Environment, Utilities: Takes steps to further investigate the extent to which GenX, a chemical used in the manufacture of Teflon, contaminates water supplies. Directs further scientific studies by state environmental and public health agencies, coordination with similar agencies in neighboring states, and requires an examination of the environmental permitting programs that describe how wastewater may be discharged in the state. Appropriates funds to the state environmental agency for use in any further scientific studies regarding GenX. Edition 2 of the bill also authorized a study intended to recommend updates to state statutes to ensure that public water suppliers were not liable for chemicals present in the water supply when state and federal authorities had no regulatory requirements.

 Proposes a suite of state and local responses to water supply contamination caused by per- and poly-fluoroalkyl substances (PFAS) such as “GenX.” Proposals directly affecting local government public water supplies include: a requirement to extend public water supply service to households whose drinking water wells have been determined to be contaminated with PFAS substances; gap funding to ensure local water systems do not have to pay for the costs of water service extension up-front; a requirement for those responsible for PFAS contamination to repay local governments for any costs related to extending public water supply service to affected households; a requirement for the State and local governments to expedite permits and approvals required to extend public water supply service in these contamination events; a directive to the N.C. Department of Environmental Quality to identify all public drinking water supplies that are currently, or may be, impacted by PFAS contamination in groundwater or surface water; development of plans to remediate PFAS contamination; directives for other research activities by state agencies and research bodies related to PFAS contamination detection and remediation in public water supplies. Redirects existing environmental research funding, such as prior awards for nutrient management research, to PFAS-related research.
