This legislation increases the burden of proof for law enforcement to initiate a civil forfeiture proceeding against an individual charged with a crime.  The burden of proof is currently a preponderance of the evidence, this bill would increase that burden to "clear and convincing evidence" which is a tougher standard.

This bill would eliminate the current per-page fees for filing deeds and other documents with the Superior Court Clerk and instead impose a flat $25 fee per document. It also increases the per-page plat filing fee from $7.50 to $10. The bill would also change the alternative Superior Court Clerk filing fees in counties with unincorporated populations of 350,000 or more.

 In response to several Georgia Supreme Court cases in recent years, this bill would waive the sovereign immunity of the state, counties, and cities with respect to certain non-monetary claims. As to local governments, a party could ask a court for an injunction or declaratory judgment based on an allegation that the government is acting in violation of 1) the U.S. or Georgia Constitutions; 2) state statute; 3) a state rule or regulation; or 4) a local ordinance other than a zoning ordinance. Such claims would have to be preceded by 30-days' notice to the government. A losing bidder in a public procurement would also have the power to challenge the award of a contract if that legal challenge is filed within 10 days of the contract's award. Other provisions limit lawsuits against government officers and employees in their individual capacity.

This legislation provides a sunset provision for the Judicial Operations Fund with complete elimination by June 30, 2022.  In state court the $125.00 fee is shared with the county general fund, the state general fund receives $75.00 and the county general fund receives $50.00.  Effective 7/1/20 county general fund receives $35.00; 7/1/21 county general fund receives $18.00; total elimination on 6/30/22.

HB 492 amends the Code section relating to a writ of possession issued by a court order to recover possession of land or property. Applications to execute a writ of possession by a sheriff or marshal must be made within 30 days of issuance of the writ, unless the application is accompanied by an affidavit showing good cause for a delay. If the landlord fails to execute a writ of possession within 30 days from the issuance of any order granting the writ of possession, the landlord must reapply and pay additional filing fees for the writ.

This legislation directs the State of Georgia to ignore any federal statute, rule or executive order; federal or state judicial order; or judicial findings that would prohibit someone from having a firearm, or from confiscating their firearm, without due process.  Furthermore, local governments will be prohibited from accepting any federal grants to implement any federal statutes or rules that would prohibit firearm ownership or would confiscate a firearm and will charge anyone, including law enforcement officers, who violate these provisions with a felony.

This legislation rolls all existing COLA's up and provides for a 5% COLA effective January 1, 2021.  Note:  The amounts listed in bill include all existing COLA's already awarded since 2006 to update the code, the only "new" salary increase is 5% on top of all the COLA's.
