This legislation amends the Transit Authority Act. It broadens the definition of "metropolitan area" to include any city, regardless of population, and the suburban area around it. It also requires an intergovernmental agreement when a new transit authority is created in an area where another transit authority or county public transit provider is already in operation.

Removes 50/50 Requirement

This legislation repeals the requirement that MARTA's ratio of operations to capital expenditures does not exceed 50/50. It also provides for a representative from Clayton county to sit on the MARTA board and makes the GRTA Executive Director a voting member. This legislation also provides for a process of appeal for citations issued in violation of authority rules and regulations.

County Impact:  For the three participating MARTA counties, this legislation provides for board representation from Clayton county as well as the northern part of DeKalb county. The removal of the 50/50 requirement on revenue spending for MARTA will provide the agency with more flexibility in its use of the revenue which will benefit the residents of the three participating counties.

This legislation would increase the truck weight for trucks hauling unprocessed wood to 84,000lbs with a 5 percent variance on state and local roads. The legislation also expands the radius from 100 to 150 miles.
 
The legislation was amended in committee to require a $250 permit in order for the trucks to run at the higher weight.

This legislation allows counties, when abandoning a road in a subdivision with a homeowners' association, to provide notice to the homeowners' association on the proposed abandonment, rather than the adjoining property owners. The homeowners' association could then exercise the option to buy the abandoned road back from the county.
This legislation was amended in committee to provide for all municipal corporations formed on or after April 15, 2005 to assume the ownership, control, care, and maintenance of county road rights of way within the municipal jurisdiction unless agreed to otherwise by joint agreement between the county and municipal corporation.
 
County Impact:  This legislation will make it easier for a county to dispose of and/or abandon a public road within a subdivision by only requiring notice to the homeowner's association.

This bill amends OCGA 48-13-50.3 which was enacted in 2015 as part of transportation funding. The bill does two things. First, it expands the coverage of the fee to make it apply to any rooms, lodgings, or accommodations instead of just hotel, motel, or extended stay rooms. Second, it reduces the amount of the fee from $5.00 to $2.50 per night.

This legislation changes the "commercial wrecker emergency tow permit," which currently allows heavy tow trucks to move disabled, damaged, abandoned or wrecked commercial vehicles, to a "commercial wrecker tow permit." The new permit now allows these large tow trucks to also tow a "replacement" commercial vehicle to the location of the commercial vehicle that is disabled, damaged or wrecked to replace the disabled, damaged or wrecked commercial vehicle.  No weight limits are increased.

This proposed constitutional amendment seeks to authorize the creation of transit community improvement districts (TCID). These districts would be somewhat similar in nature to the current community improvement districts (CID) but with some notable exceptions. The TCID purposes are limited to extensions of existing transit rail infrastructure (including rail lines, terminals, rail cars, and associated capital expenditures) and cannot be changed. Once created, the governing board may levy "appropriate taxes, fees, and assessments" upon real property used for nonresidential purposes which is located within the TCID. There is no description as to what type or form these "appropriate" taxes might take. Unlike in a CID, there is no cap on the rate of these taxes. TCID's will be created by general law (in contrast to CID's which are created by local law) and may be for single cities or counties or for any combination of cities and counties.

This legislation requires counties that participate in the Georgia Regional Transportation Authority (GRTA), Metropolitan Atlanta Rapid Transit Authority (MARTA), or some other mass transportation regional system to hold a referendum prior to the spending funds on establishing, maintaining or operating a fixed guideway transit (i.e., a public transportation system that uses and occupies a permanent, separate right of way reserved for the use by trains or a bus rapid transit systems).
