| This legislation is a restructuring of the Civil Forfeiture Procedure Act which impacts drug forfeitures and seizures. This statute is one of law enforcement's most effective tools in bringing down criminal enterprises. The district attorney, through a judicial process, can seize cars, cash and property of drug dealers and other criminals. Many county commissioners refer to this forfeited property as drug fund money. The funds and property are used for law enforcement training, equipment and investigative expenses. The revised HB 1 standardizes the reporting requirements for law enforcement, and creates a new process for district attorney forfeiture funds. |

It creates a new fee to cancel a trade name registration of $22.00 and creates a new fee to re-registering an existing trade name of $20.00. The bill also requires $5.00 of the fee to be paid to the Superior Court Clerk's Cooperative Authority to fund the creation and maintenance of the Statewide Registry of Trade Names. On January 1, 2020, the fees will be reducted by $5.00 and the funding of the Statewide Registry of Trade Names will be discontinued. |

| This legislation expands probate courts' jurisdiction to include misdemeanors related to alcoholic beverages and under age persons; to livestock running at large, to criminal trespass; to littering, to illegal dumping, to shopfliting ($500 or less); to theft ($1,500 or less); to fourth degree forgery; to obstructing or hindering a law enforcement officer, firefighter, EMT or other emergency medical professional; to obstructing or hindering a person making an emergency call; to giving false name or date of birth; to affray; to disorderly conduct; to harassing phone calls; to unlawful conduct during a 9-1-1 call; to public drunkenness; to possession of marijuana (one ounce or less); to possession or use of drug related objects; and to mandatory education for children between the ages of six and 16. The probate court would only have the ability to hear these cases if the defendant waives their right to a jury trial in writing. |

| This legislation amends the Statewide Jury Act passed in 2010 to give oversight of the selection of grand jurors by the clerk from county master jury list to the presiding judge in consulation with the district attorney. This bill provides that prior to empaneling, swearing and charging the grand jury, the judge and the district attorney may examine prospective jurors as to their qualifications to serve. This eliminates the potential appointment of convicted felons to serve on grand juries. |

| This legislation makes several changes to the Responsible Dog Ownership Law. First, it allows county commissioners to appoint more than one individual as dog control officer. Second, in addition to animal control boards or boards of health conducting hearings to determine if a dog is dangerous or vicious, these hearings may also be held before the probate court. Third, it shortens the time period that a hearing can be requested by a dog owner and reduces the amount of time that a vicious or dangerous dog must be held if no owner can be found. |
