This legislation removes several provisions of Georgia law that have been deemed outdated, obsolete and/or unconstitutional.  It includes removal of state assistance for infrastructure for certain planned communities, as well as preclearance requirements.  Language regarding membership in the Communist Party is removed from loyalty oaths.  It removes the requirement that peddlers and itinerant traders register with the probate judge and changes the term "mental retardation" to "intellectual disability" throughout Georgia code.

Current law will permit an annexation through the referendum method if the voters in the area to be annexed approve by a majority vote. This legislation requires both a majority vote by those in the area to be annexed as well as those in the existing municipality seeking the annexation. Failure to secure a majority vote in either area requires a two-year waiting period before the annexation can be attempted again.

This legislation allows the deannexation of territory by a local act of the General Assembly to create an unincorporated island if said territory is simultaneously annexed into another municipality on the same date as the deannexation - thus eliminating the island.

This legislation allows counties, when abandoning a road in a subdivision with a homeowners' association, to provide notice to the homeowners' association on the proposed abandonment, rather than the adjoining property owners. The homeowners' association could then exercise the option to buy the abandoned road back from the county.
This legislation was amended in committee to provide for all municipal corporations formed on or after April 15, 2005 to assume the ownership, control, care, and maintenance of county road rights of way within the municipal jurisdiction unless agreed to otherwise by joint agreement between the county and municipal corporation.
 
County Impact:  This legislation will make it easier for a county to dispose of and/or abandon a public road within a subdivision by only requiring notice to the homeowner's association.

This legislation addresses the pension obligations of a county pension plan when a new city is created. The unfunded pension liability must be established and verified by an independent actuarial study ordered by the county board of pension trustees. The unfunded pension liability must be directly attributable to the county's inability to provide services in the newly incorporated area. HB 711 allows the county to establish a special district within the newly created city in which to collect the pension obligation created when the district was removed from the unincorporated area. Additional property taxes will be collected in the special district at a rate sufficient to retire the pension obligation in 30 years.

This legislation, similar to SB 272, would allow for the creation of townships via local legislation with land use, zoning, subdivision, building permit and code enforcement powers, if the voters first approve a statewide referendum approving a constitutional amendment. Companion resolutions, HR 1051 and SR 724, if passed, will call for the statewide referendum to amend the constitution allowing townships to have zoning powers. Townships could levy up to a .5 mill property tax, annex and transition to cityhood. Though counties would have no say in the above decisions, counties must continue to provide all services and infrastructure to the area as they would any unincorporated area. Counties would have an opportunity to comment on township decisions, but nothing is binding or mediated.
