This legislation changes the Service Delivery Strategies Act to prohibit a water service provider from charging higher water or sewer fees to customers outside their political jurisdiction - unless otherwise provided by a contract.  It applies only to cities created since January 1, 2000, and others that may be created in the future.  The water service provider shall have no obligation to serve the outside customers/entity if an agreement is not reached, and that service could be cut off with a 6-month written notice.

This legislation requires electrical utilities (using eminent domain to construct or expand electric transmission lines) to consider the existing land uses, existing environmental conditions, engineering practices related to the construction and operation of the line and costs related to the construction, operation and maintenance of a line when determining where to locate an electrical line. Land uses and environmental conditions are to be given priority in this consideration process.

This bill requires electrical utilities (using eminent domain to construct or expand electric transmission lines) to bear the burden of proof that they considered existing land use, corridors, environmental conditions, engineering practices related to the construction and operation of the line, as well as the costs related to the construction, operation and maintenance of the line when selecting the location of the electrical line.

This legislation expands the uses of the Georgia Environmental Finance Authority's Reservoir Fund to cover leak-detection, conservation-type and other water supply system assets. The Reservoir Fund will be renamed the "Georgia Reservoir and Water Supply Fund." While ACCG certainly recognizes the importance of leak detection and conservation, GEFA currently has about $318 in loaning capacity available for these purposes via its Georgia Fund, Clean Water and Drinking Water loan programs; whereas the Reservoir Fund only has $41 million in loaning capacity.

This legislation mandates that a local jurisdiction's water rate charged to a multi-family dwelling served by a master meter be no more than the water rate charged to a single family dwelling. ACCG is working with the Georgia Association of Water Professionals to understand the impact of this bill, any rate differentials, and will be commenting to the General Assembly.

This legislation changes Georgia's Utility Facility Protection Act (GUFPA, or "Call Before You Dig" Law).  It revises the definition of large projects and procedures for addressing unlocatable utilities; reinforces that sewer laterals are not owned by local governments; clarifyies that routine road maintenance is not "excavating" for the purposes of the GUFPA Act; and alters the makeup of the GUFPA advisory committee.  This bill does not expand penalties for local governments found in violation of the law, nor does it expand the Public Service Commission's regulatory reach over local governments or water authorities.
