Revenue & Finance Sales Tax-Local
This bill expands the criteria for the 'establishing or relocating quality jobs' income tax credit, to include projects that create at least 50 jobs and invest at least $2.5 million in property acquisition. Additionally, the bill provides for state and local sales and use tax exemptions for: 1) admission tickets to arts facilities; and 2) property used in the renovation or expansion of a theater that contains an art museum, symphonic hall, and theater that charges for admission and is owned by a Section 501(c)(3) entity. This sales tax exemption is aimed at the Woodruff Arts Center in Atlanta.

Revenue & Finance Sales Tax-Local
This legislation provides a sales tax exemption in certain enterprise zones: those involving investment of $400M or more in a "chronically underdeveloped area." The exemption for state sales tax would be automatic; exemption from local sales tax would require approval of the local governments. School taxes are not impacted by this bill. A proposed substitute to this bill would make the local sales tax exemption automatic in the same manner as state sales taxes; however, consistent with existing law, local government approval is still necessary for creation of such enterprise zones.

2018/03/23 Report General County Government Government Immunity Larry Ramsey Public Safety and Courts

Following recommendations of the Governor's Court Reform Council and in response to several recent Georgia Supreme Court decisions, this bill would allow for a limited waiver of the state's sovereign immunity so as to allow lawsuits against the state for injunctions and/declaratory judgments where a state law is alleged to be unconstitutional. As amended in House committee, the substance of HB 674 was added to this bill, waiving county and city sovereign immunity for injunctive/declaratory relief for allegations that the local government has violated a constitutional provision, statute, state rule/regulation, or local ordinance. Immunity would still apply to any  related monetary damages. The amended version also permits direct appeals of trial court orders ruling that immunity does not apply to a claim (from HB 256).

A substitute version approved by the Senate Judiciary Committee removes local governments from the scope of this bill but retains the direct-appeal authorization.

Revenue & Finance Sales Tax-Local
This bill is DOR's annual income tax conformity bill. However, it also contains many provisions which affect counties. First, it revises TAVT and provides that no TAVT is collected on replacement titles for vehicles which are not less than 15 years years old. Second, it completely exempts jet fuel from SPLOST, ESPLOST, and single county TSPLOST (and presumably MOSt although it is silent on this point). Third, it partially exempts jet fuel from LOST and MARTA levies and rates in effect on December 30, 1987. Fourth, it redirects local sales and use tax revenue derived from jet fuel to state aviation programs and purposes and allows any excess to be appropriated for other purposes.  ACCG opposes the sales tax exemption for jet fuel, which is estimated to cost local governments up to $21M per year (the vast majority in Clayton County).
HR 0993 NeutralConstitutional Amendment to Authorize Business Courts with Statewide Jurisdiction Chuck Efstration
5/6/2018 Effective Date Judiciary Judiciary -
Debra Nesbit Public Safety and Courts
This legislation is to put a constitutional amendment question on the ballot that if approved, would authorize the creation of a statewide business court with the equal jurisdiction to the superior courts.  These judges will be appointed by the Governor and subject to approval by a majority vote of both the house and senate judiciary committees.
