The full 11th U.S. Circuit Court of Appeals has ruled that previous Engle progeny rulings and standards are allowed as evidence in current and future trials. The court's ruling Thursday followed a February 2016 ruling from a three-judge panel that vacated an April 2015 ruling. That ruling said Engle plaintiffs must prove the cigarettes smoked by themselves or relatives were defective in order to receive damages.
