SEC calls off probe into Tyson’s alleged broiler price fixing

Tyson Foods Inc. announced today that the Securities and Exchange Commission (SEC) has notified the company that it does not intend to recommend an enforcement action as a result of the agency’s investigation related to an antitrust lawsuit filed against the company. SEC sent Tyson a subpoena in January following up on a class-action lawsuit filed in September 2016 that accused Tyson Foods and other chicken processors of colluding to fix broiler prices since 2008. Tyson denied the allegations and filed motions to dismiss the suit in U.S. federal court in Chicago.


In letter dated Aug. 22, according to Tyson officials, SEC said the agency has completed its probe and, “based on information it has on that date, it does not intend to recommend an enforcement action by the SEC against Tyson.”
