Judge approves dismissing FDA from Santa Fe marketing lawsuit

A federal judge in Florida has dismissed the Food and Drug Administration from a consumer lawsuit involving a Reynolds American Inc. subsidiary. The ruling, issued Friday by Judge Robin Rosenberg, involved plaintiff Justin Sproule and Santa Fe Natural Tobacco Co. The complaint was dismissed without prejudice, which means it could be refiled. Rosenberg determined that Sproule did not have sufficient standing to sue the agency.
