ICYMI, the U.S. Court of Appeals for the 8th Circuit on Dec. 21 denied a petition by the Organization for Competitive Markets challenging USDA's rollback of an interim final rule that would have made it easier for growers to sue meatpackers on the basis of unfair treatment. The appellate court ruled that the decision to reverse the rule, part of what's known as the GIPSA rules, was not "arbitrary and capricious," as OCM argued.
