Transporting crops via FLC H-2A labor at-risk

H-2A Farm Labor Contractors are at-risk of H-2A application denial resulting from recent U.S. Department of Labor, Office of Administrative Law Judges affirmation of a decision to deny an application on grounds that the work was not sufficiently agricultural to qualify for H-2A certification. Rep. Yoho (R-FL) co-authored a letter to the U.S. Department of Labor finding the recent interpretation to be inconsistent with previous Department practice and what should be a well-understood point of view over the integral nature of transporting a crop from farm, off farm to a first point of processing. The letter requests policy reversal, or at a minimum a delay in the implementation of what would be a new standard in order to protect ongoing harvest activities and allow planning time for next season's harvest.
