EPA and Army Corp deliver new definition of WOTUS

On January 23, the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corp of Engineers (Corp) finalized the Navigable Waters Protection Rule that will better define “Waters of the United States” or WOTUS. The EPA and the Corp first proposed this rule in February 2019 as a means of focusing regulatory compliance efforts on “navigable waters.” The new rule clarifies for landowners when a CWA permit is necessary and specifically exempts areas such as artificially irrigated fields, roadside and farm ditches, and farm and stock ponds from CWA permitting requirements.
