New H-2A subsistence rate effective 3-10-2021

Effective today, 3-10-2021 the H-2A subsistence rate increased to $13.17 per day for workers who do not present receipts.  Generally an H-2A employer should NOT ask workers for receipts.  If a worker presents receipts, the maximum subsistence reimbursement remains $55.00 per day.

For workers arriving today and after today, subsistence pay must be computed at the new rate of $13.17 per day for each day of travel (per 24 hours) from the place of recruitment.  The new rate will apply even though the old rate of $12.68 may appear in your H-2A work contract.  Typically, the inbound subsistence pay will be 3 days x $13.17 = $39.51 when traveling by bus, however you will need to confirm the number of days your workers are in transit.  Typical outbound subsistence pay is 2 days x $13.17 = $26.34 to most points in Mexico when traveling by bus or 1 day if by air.
