State law prohibits county oversight of mass-production chicken, hog farms

I continue to get calls of concern about the proliferation of chicken houses that have been and are being built recently. In a nutshell, the Farm Act of 2018 prohibits counties from being involved in agricultural operations such as mass-production farms for hogs and poultry. Since much of our county is deemed agricultural/residential, no hearing would be in order for a farm to be built anywhere within land of that designation. Nearby residents do not receive any notice, and many are unaware of anything occurring until supply trucks begin to come into the area. So long as farms operate within the norm for such operations, they cannot create a nuisance.
