The N.C. Pesticide Board will meet Wednesday, June 9, to consider whether to settle the state’s long-running case involving Florida-based Ag-Mart Produce Inc.

The board will meet at 1 p.m. in the Martin Building at the State Fairgrounds. The meeting is open to the public.

The board previously found Jeffrey Oxley, Ag-Mart’s regional manager in North Carolina, guilty of 48 violations of state pesticide regulations stemming from his work on farms in Brunswick and Pender counties in 2004 and 2005. The board ordered Oxley to pay $24,000 in civil penalties and revoked his pesticide applicator’s license for two years.

Ag-Mart appealed the decision to Wake County Superior Court. Oxley’s license revocation was stayed pending the outcome of the appeal. The court has not taken up the appeal yet.

Under the settlement agreement proposed by Ag-Mart and the N.C. Department of Agriculture and Consumer Services, Oxley would pay the department $24,000 to settle the violations from 2004 and 2005, plus $1,000 for a 2006 violation in Pender County.

In addition, Ag-Mart would fund a training program for farm workers during the 2010 and 2011 growing seasons.

The company also would agree to drop its legal appeals.

Oxley would be allowed to keep his pesticide applicator’s license, as long as he or anyone he supervises did not commit a violation of state pesticide regulations within six months of the effective date of the agreement.

The N.C. Pesticide Board regulates the use, application, sale, disposal and registration of insecticides, fungicides, herbicides and other pesticides in the state. Its seven members are appointed by the governor.
