Dewey Hudson attacks agriculture

Below is a copy of the letter that was sent to Dewey Hudson in reference to his slanderous ads against me (Brent Jackson candidate for NC Senate and NC Agribusiness Council Member).


Dear Mr. Hudson and Mr. Young:
We represent Mr. Brent Jackson. We have been engaged to take all necessary steps to protect his reputation. In the hope that litigation may be avoided, we request that you cease and desist from making any further fraudulent and slanderous accusations against Mr. Jackson as part of Mr. Hudson’s campaign for district 10 of the North Carolina Senate.


You have recently sent a mailing that contains two false statements about Mr. Jackson. We can also assume that you have made these statements with legal malice since the falsity of both statements is obvious or could have been discovered with reasonable diligence.


First, Mr. Jackson has never admitted nor been found guilty of hiring any illegal aliens. You cite an article from the News and Observer dated 7/25/07, to support your false statement. Nowhere in this article is there a statement or admission by Mr. Jackson that he in fact has ever hired an illegal alien. The article contains a conclusion by the reporter that Mr. Jackson had hired illegal aliens in the past but no such statement by Mr. Jackson. Please immediately cease and desist from any further fraudulent use of the United States mail, false misrepresentations of the text of the article, or blatantly false statements that Mr. Jackson has admitted to any such illegality.


Second, Mr. Jackson never refused to pay any employee who suffered a workplace illness or injury. The employee who is referenced in your mailing suffered a heat illness while working on Mr. Jackson’s farm. This work place illness was covered by Mr. Jackson’s workers’ compensation insurance. As I am sure you already know, or as you could have easily discovered with reasonable diligence, once a matter is accepted by an employer’s workers’ compensation carrier, the decision on whether to compensate an injured employee is made by the carrier or by the Industrial Commission if the carrier refuses to reach a settlement with the injured employee. Mr. Jackson had no authority to pay or not to pay the injured employee once control of the matter was assumed by Mr. Jackson’s carrier.


We are aware that several other Republican candidates for The North Carolina Senate have also been falsely accused of legal violations they did not commit in mailings paid for and coordinated with the North Carolina Democratic Party. Your mailer defaming Mr. Jackson is obviously part of a concerted and fraudulent pattern of activity to falsely accuse Republican candidates of criminal violations.


Should you continue to use the United Sates mail to make similar fraudulent statements about Mr. Jackson, falsely accusing him or criminal violations and defaming him in his profession, he intends to pursue all available remedies. These will include claims against you and the North Carolina Democratic Party, and all officers and agents of the State Democratic Party who have conceived and authorized these blatantly fraudulent allegations, for defamation and RICO violations.


We would appreciate hearing from your counsel so that both campaigns may re-focus their energies on fair campaigning as opposed to litigation.
