House of Raeford pollution case dismissed

A federal judge has dismissed a Department of Justice lawsuit alleging environmental crimes against North Carolina poultry processor House of Raeford based on a technicality.

James A. Beaty, chief judge for the U.S. District Court for the Middle District of North Carolina, said prosecutors failed to bring their case to a speedy trial, according to court documents filed late last month.
In an indictment filed in November 2009, the feds accuse House of Raeford of sending untreated processing waste from its Raeford, N.C., plant to the city’s treatment facility in violation of federal clean water laws.

Beaty said he would allow federal prosecutors to file new criminal indictments against House of Raeford and the Raeford plant manager.
