Poultry producer sues EPA, for a change

The owner of West Virginia’s Eight is Enough farms has filed suit against the federal Environmental Protection Agency over the agency’s efforts to enforce the Clean Water Act (CWA) provisions on her farm.

Lois Alt says the EPA overstepped its authority when it ordered her to stop polluting nearby streams and pay for discharge permits, calling the agency’s actions “arbitrary,” “capricious” and “illegal,” according to court documents.

Alt doesn’t disagree that dust and particles of manure might get picked up and deposited in nearby tributaries, but says it is agricultural storm water and not “process wastewater” which would be regulated under the CWA.

The EPA sent an inspector to the farm as part of its ongoing efforts to clean up the Chesapeake Bay and its watershed.

Alt asks that the EPA’s order be set aside. If enforced, Alt could face fines of up to $37,500 a day.
