N.C. Legislature passes Metal Theft Prevention Act of 2012

This week, the General Assembly gave final approval to the Metal Theft Prevention Act of 2012. The legislation strengthens state laws regarding copper and nonferrous metal theft by requiring permits for metal recyclers, eliminating cash payments for copper, and requiring metal recyclers to videotape or photograph persons who sell nonferrous metals. In addition, the bill increases criminal penalties to those who cause damage to utility installations, buildings or houses in order to steal copper or other nonferrous metals.

The legislation defines nonferrous metal as metals not containing significant quantities of iron or steel, such as copper, aluminum other than aluminum cans, catalytic converters, or stainless steel beer kegs or containers.

Once signed into law by Gov. Perdue, the new law becomes effective October 2012.
