Supreme Court agrees to hear Decker v. Northwest Environmental Defense Center

The Supreme Court agreed this week to hear a case from the Ninth Circuit, Decker v. Northwest Environmental Defense Center, which overturned long-held silviculture exemptions for forest roads. Earlier this year NASDA joined a number of state agency associations in urging EPA to defend its current practice of treating forest management activities as nonpoint sources. If the Supreme Court does not overturn the Ninth Circuit decision, many of these activities would be required to obtain NPDES permits.
