Appeals court upholds Tyson victory on donning and doffing

The Eighth U.S. Circuit Court of Appeals has upheld a lower court decision that Tyson Foods is not under-paying the workers at its Lexington, Neb. plant for the time it takes them to put on and take off safety gear and other pre- and post-shift tasks.

According to this latest ruling, the plaintiffs failed to show any error in the May 2011 ruling.

“We’re pleased the Court of Appeals upheld the jury’s verdict in our favor,” Tyson spokesman Worth Sparkman told Meatingplace. He declined to comment further due to other pending wage and hour litigation.

Tyson still faces similar lawsuits filed by workers at its plants in the Nebraska towns of Dakota City and Madison.
