New (N.C.) state E-Verify law to take effect for private employers

The N.C. General Assembly approved a new law requiring employers and local governments to use the federal E-Verify system for new employees in June 2011. The law phases in effective dates for private employers depending on the number of employees they have.

The portion of the law that applies to private employers will become effective on Oct. 1, 2012, for employers with 500 or more employees in North Carolina. Eventually, this law will apply to all private employers with 25 or more employees in North Carolina.

The law becomes effective for private employers on the following dates:
l Oct. 1, 2012—employers that employ 500 or more employees in North Carolina
l Jan. 1, 2013—employers that employ 100 or more but less than 500 employees in North Carolina
l July 1, 2013—employers that employ 25 or more but less than 100 employees in North Carolina

The N.C. Department of Labor is required to accept and investigate valid complaints that specifically allege that a private employer has violated the E-Verify law by failing to verify a newly hired employee’s work authorization through E-Verify. Please note that NCDOL does not have jurisdiction to investigate complaints regarding state agencies, counties, municipalities or other governmental bodies.

The E-Verify program is a web-based system operated by the U.S. Department of Homeland Security in partnership with the Social Security Administration that allows participating employers to electronically verify the employment authorization of newly hired employees.
