Poultry pollution trial gets under way in Maryland

The lawsuit alleging that a Maryland chicken farm and Perdue Farms polluted waterways feeding into the Chesapeake Bay went to trial Tuesday with attorneys for both sides presenting opening arguments in U.S. District Court in Baltimore.

The lead lawyer for the Waterkeeper Alliance said levels of bacteria and other pollutants in water samples taken around Alan and Kristin Hudson’s farm were “off the chart,” The Baltimore Sun reported.

Lawyers for the Hudsons and Perdue, which owns the birds grown on the Hudson farm, called the environmental group’s case "conjecture and speculation" and an attempt to portray the poultry industry as a major source of pollution in the Chesapeake Bay.

A key issue in the closely watched case is whether Perdue should be held liable if the court finds that chicken waste was running off the Hudsons' farm and contaminated the water.

The trial is expected to last three weeks.
