Hudson Farms, Perdue lawsuit defense: Cows, not chickens polluted water

As a lawsuit accusing Hudson Farms and Perdue Farms of polluting local water supplies in Maryland enters its third week, the defense has called in an expert who is shifting the blame on the offending runoff on cows instead of chickens.

A microbiologist at Virginia Tech told the federal judge presiding over the trial that he believes that manure produced by the 40 cows on Hudson Farms are the actual source of the alleged pollutants. The expert witness noted that as many as 600 tons of manure from cows may be the source of the nitrogen in nearby streams and other local bodies of water, including the Chesapeake Bay, according to local reports.

A group called the Waterkeeper Alliance filed the lawsuit in U.S. District Court in Baltimore accusing Hudson and Perdue of polluting the water supply as a result of chicken manure runoff. The case is being closely monitored because it may determine whether Perdue should be held liable if the court determines that Hudson Farms is responsible for polluting local water.
